Waiver of Liability, Media Release, and Newsletter Agreement for Houston Town Futsal Club

In consideration of being permitted to participate in the activities of Houston Town Futsal League, LLC, I, on behalf of my heirs, executors, survivors, beneficiaries, administrators, and assignees, and myself, represent, warrant, and agree to the following:

1. I do not have any health-related conditions, disabilities, etc., that would restrict my participation in Houston Town Futsal League activities. I have not been advised my any health professional to refrain from participating in activities similar to Houston Town Futsal League activities.
2. I am hereby warned of, and I understand, the risks of participating in Houston Town Futsal League activities and that participation in Houston Town Futsal League activities can result in bodily injuries or even death. I hereby accept and assume the risk of and full responsibility for any loss, property damage, personal injury or death, which may be sustained as a result of my participation and involvement in Houston Town Futsal League activities.
3. I have read and understand the Rules and Regulations provided by Houston Town Futsal League and agree to abide by them.
4. I waive all claims and actions (including claims for negligence or strict liability) against Houston Town Futsal League, its organizers, captains, volunteers, sponsors and all participants including, without limitation David Redd (hereafter collectively referred to as “Houston Town Futsal League”, and agree to hold harmless, defend and indemnify Houston Town Futsal League from, any and all claims, actions, losses, costs, expenses, damages, and liabilities, including actual attorneys’ fees and related costs (including claims for negligence or strict liability), that may be incurred as a result of my participation in Houston Town Futsal League activities. It is my intent that Houston Town Futsal League shall not be liable for any damage, loss or injury to me in any way connected to my participation in Houston Town Futsal League activities and I hereby release and discharge Houston Town Futsal League from any claims or liability for damages, loss or injury to me in any way connected to my participation in Houston Town Futsal League activities (including claims for negligence or strict liability).
5. I acknowledge and agree that my relationship and involvement with Houston Town Futsal League does not create a bailment and that Houston Town Futsal League is not responsible for any items that are lost, stolen, or damaged.
6. I AGREE TO WAIVE THE RIGHT TO A TRIAL BY JURY OF ANY MATTERS ARISING OUT OF OR IN ANY WAY CONNECTED TO MY PARTICIPATION IN HOUSTON TOWN FUTSAL LEAGUE ACTIVITIES.
7. This Assumption of Risk, Hold Harmless, and Indemnity Agreement (hereafter “Agreement”) shall be construed and interpreted pursuant to the laws of the State of Texas, and if any portion thereof is held invalid, I request the remainder continue in full force and effect.
8. I understand this Agreement is the final, complete, and entire agreement between Houston Town Futsal League and me. All prior or contemporaneous written and oral statements, negotiations, representations, agreements, and warranties related to or pertaining to this Agreement are superseded and merged into this Agreement.

This agreement applies to all injuries or damages which may be experienced by me or my heirs, executors, survivors, beneficiaries, administrators and assigns, EVEN IF CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF HOUSTON TOWN FUTSAL LEAGUE, LLC OR ANY CONSITUENT MEMBER THEREOF AND INCLUDING ANY CAUSES OF ACTION OR CLAIMS THEREFOR FOR STRICT LIABILITY.
